General Terms & Conditions of SagaPoll

These Terms and Conditions constitute a legally binding agreement made between you and SagaPoll, concerning your access and use of our website and app as well as any other media form, media channel, related, linked, or otherwise connected thereto. You agree that by accessing the site and the app, you have read, understood, and agree to be bound by all of these General Terms and Conditions.

  1. The SagaPoll community

SagaPoll is a Sagaci Research Internet-based initiative, whose mission it is to provide reliable information to all kinds of companies and institutions around the world. This information is obtained thanks to the collaboration of people like you who agree to share their opinions and habits. Collaborating with us, you help companies make good decisions and create products and services based on the real opinion of the society. This and your security is what moves us, so you can be at ease: we will never ask you for money or send you any type of advertisement.

All the SagaPoll members are compensated through a point’s scheme. For each research activity that we request of you and that you complete, you’ll be compensated with a number of points proportional to the effort required.

Participation in SagaPoll is voluntary and limited to only one account per person. This way, we ensure the representativity and quality of the information that we provide to our clients.

SagaPoll is intended for those who are at least 16 years old. Persons under the age of 16 are not permitted to register in our community.

  1. Register

Registration for SagaPoll will always be free.

By agreeing to be a member, you commit to providing us with current, complete and accurate information about you, keeping it up-to-date whenever we request it and we commit to using this information solely for statistical purposes, always separating your opinions from your personal data.

Our objective is to obtain representative data of the opinions of society, for that reason, as a member you will only be able to have one SagaPoll account. In case of not fulfilling this requirement, we reserve our right to discharge your collaboration. If you decide to voluntarily leave SagaPoll, you will not be able to activate your account again, unless it is expressly authorized by us.

  1. Personal account

When you register, you will have access to your personal SagaPoll account. You can access this account using your credentials.

As a member, you will be responsible for maintaining the confidentiality of the data for access to your personal account and for adopting any measures that may be useful for keeping it a secret. Remember: you are solely responsible for its safekeeping and use, as well as updating and maintaining the accuracy of the information that you provide us with it.

We understand that your account will always be used by you. This is why you must immediately notify us of any access restriction, modification or cancellation of the account, as well as any problem related to accessing your personal account. We reserve our right to cancel or block your account to protect you, in case of identity theft or other fraudulent activity.

As a member, you agree not to transfer the use of your personal account to third parties, unless you have our written permission.

  1. Personal data protection and privacy

Your privacy is very important for us. That is why we are inspired by the European Union’s data protection regulations, which represent the highest standard of privacy worldwide. If you want to know more in detail how we protect the information you share with us, visit our Privacy Policy.

  1. Activities required by members

To earn points as part of SagaPoll, you must complete the research activities that we regularly assign to you. Most of our members receive surveys or tasks to be performed regularly, but the frequency can vary depending on each demographic profile. The purpose of these activities is to collect information on your opinions and habits, and you will be compensated according to the effort they require.

Your collaboration is voluntary and free. In no case will you be considered an employee. 

Not all surveys or tasks earn the same amount of points as these depend on the complexity and the amount of time it can take to complete it.

a.     Your obligations as a member

As a member, you are required to participate in an honest way in the projects that we invite you to.

Therefore, we consider that you participate a dishonest way if:

  • We detect that you have provided incoherent/fraudulent information.
  • We determine that the time you’ve used to complete a study is insufficient to have read in detail all the content of it.
  • The information you provide us does not match the details you provided when you registered or when you most recently updated said information.
  • We detect that you did not maintain the confidentiality of the content shared with you. For the purposes of any doubt, you are not permitted to share any content including texts, images and videos that we show you while you participate, through any media, without our written consent.

Breaching these obligations may be sufficient reason to delete your SagaPoll account and lose the points earned to date.

b.     Your rights

You are free to take part in the projects we invite you to take part in. If you think a project is too tedious, it asks for information you do not wish to provide, or you do not wish to take part in it, simply ignore it. You have the right to receive compensation in the form of points in exchange for your correct and complete participation.

  1. About our rewards scheme

As a member, you will earn points that can be redeemed for money as long as you take part in market and opinion surveys or in our tasks.

The number of points you will earn in exchange for these activities will vary based on various factors set by SagaPoll. By way of example, the number of points you will earn for taking part in a survey will differ according to the length of the survey and degree of difficulty or sensitivity of the topics that are covered.

We will notify you of the number of points you have earned in an activity upon completion. You can also check this information in your personal account.

We reserve the right to take any points from the account that we have delivered to you in exchange for taking part in an activity if we observe that you have not done so in the honest manner described above.

From time to time, SagaPoll may ask you to participate in a prize draw. Such draws will be governed by the respective Terms and Conditions specified and displayed for each prize draw.

  1. Redeeming points and payment

The points earned shall be transferred to your bank/mobile money account no later than 30 days following the successful fulfillment of the corresponding task and acceptance of its result by SagaPoll, IF and WHEN you have reached 5000 points and have updloaded the following information in order to us to proceed with the payment: National ID card, bank name, bank account number, mobile number, mobile money operator name. SagaPoll does not assume any obligations if you insert the wrong bank details as per this clause. The payment shall be made in the currency of the country where you’re located. The conversion rate between points/money is approximately 5000 points = 20 US dollars. In any case, we will communicate to you the final and precise conversion rate in the event of redeeming your points. 

After correctly filling the administrative details, our team will validate them. This process can take up to 72h. You will only be able to redeem the points for money after that validation. If the documents aren’t approved, you will receive a notification informing which fields need to be corrected. You will receive the payment within 30 business days.

  1. Referral links

You may be able to earn extra points by referring friends and family to the SagaPoll community, by sending them a unique code that we provide to you. The conditions linked to the awarding of such extra points are explained in the Invite section of the App. When referring to new members, you agree to not pose as or claim to represent SagaPoll. You agree to make clear to any prospective members you refer that they will be using your unique referral code and that you will receive points if they join the SagaPoll panel using your referral code.

  1. Cancellation of your account

Your personal account may be canceled for three reasons:

a.     Because you decide to abandon SagaPoll

You can leave SagaPoll voluntarily at any time from your personal account. In this case please contact SagaPoll on contact@sagapoll.com. SagaPoll will cancel your account and cease to contact you within 7 days of receiving notice from you that you wish to terminate your membership. You therefore acknowledge and agree that if you terminate your membership you may receive emails from SagaPoll for a period of 7 days after the date of your notice. Once you leave, you will lose the right to redeem the points collected to date.

b.    Because SagaPoll cancels your account

For our part, we reserve the right to delete your SagaPoll account if:

  • You have not provided exact, current and complete information.
  • We detect that you have registered at SagaPoll on more than one occasion.
  • We detect that you have taken part dishonestly in the activities that we have offered you.
  • You use inappropriate, offensive, threatening, defamatory or deceptive language in surveys, emails and/or in any other official channel of SagaPoll, including social networks.
  • You breach any of the obligations indicated in these General Terms and Conditions or any other cause that SagaPoll considers, prior communication.

SagaPoll reserves the right to delete your account under any of the above circumstances or, alternatively, to warn you to rectify the cause of the breach.

c.     Because you have been inactive for too long

We also reserve the right to delete your SagaPoll account and reset your points in the following cases:

  • If you do not take part in a survey or if you have not redeemed any points during a period of 6 months.
  •  If you do not access your personal account for 6 months.

In any of the above cases, we will consider you to have entered a “period of inactivity.” In this case, we will be obligated to inform you that your points have been canceled through any of the channels used to invite you to participate in surveys, establishing a period of 7 days during which you will have the right to redeem your points if you have more than 5000 points. After this period, SagaPoll will consider its debt with you settled.

SagaPoll reserves the right to modify the “period of inactivity.” To do so, we will announce any modification in advance, whether by notifying all of our members or by placing an announcement on our app or website.

  1. Intellectual and industrial property

As a member, you recognise and accept that all intellectual and industrial property rights on the contents and/or any other items found on the SagaPoll website, the SagaPoll mobile app and especially in the surveys to which you have access (including, but not limited to, trademarks, logos, texts, images, videos, graphics, etc.) belong to SagaPoll and/or third parties.

Neither access to SagaPoll nor your participation in published surveys will entail, in any case, your acquisition of the property rights of the contents that appear therein.

Therefore, the exploitation, reproduction, distribution, public communication, making available to the public and/or processing, including translation, of all the contents subject to industrial and intellectual property housed in the sites described above, is strictly prohibited by any means, without the prior authorization of SagaPoll.

In the case that you break any of the regulations, we reserve the right to exempt your collaboration by canceling your account.

  1. Compliance with laws

By agreeing to be a SagaPoll member, you commit to access and use our app and website in accordance with the law, these General Terms and Conditions and the moral standards and generally accepted best practices.

Furthermore, you commit not to use the website for illicit or illegal purposes, to harm the rights of third parties, or in any way that may damage or disable the website or third-party rights.

These General Conditions will be governed and interpreted according to the Hong Kong legislation and will not limit any protection to the consumer in which you may be entitled under the legislation in your country of residence.

SagaPoll is a registered brand. The fact that it isn’t shown with the signals ®, © o ™ in a document, on the internet or in the app it cannot be interpreted as if it wasn’t a registered brand and/or can be used without the previous authorisation written by SagaPoll. This way, it is strictly forbidden to use both the logo and the name of SagaPoll for personal benefit and to disseminate information by pretending to be an employee or representative of the brand itself.

  1. Operation and availability of our site and app

SagaPoll does not guarantee the availability and continuity of the operation of the SagaPoll website or SagaPoll mobile app. When dealing with computers, electronics and the Internet, there may be a reason why something can go wrong.

In the sudden case of suffering from malicious third-party attacks, although we do everything we can to ensure that this never happens, SagaPoll will never be liable for any direct and indirect damages that may arise from these possible problems.

In order to participate in SagaPoll, you must be connected to the Internet. We cannot be responsible if, during the participation on the surveys, your device suffers from a lack of connection. Be aware that you may not receive the points if, for some reason, your survey could not be submitted. In some cases, you won’t be able to redo the survey.

  1. Links to other websites

Through SagaPoll you can access websites belonging to and/or managed by third parties. SagaPoll is not responsible for third parties since they operate independently. However, if we become acutely aware that a third party is involved in activities we do not tolerate, their links will be removed from our community.

  1. Indemnification

You agree to indemnify, defend and hold SagaPoll and its parent, subsidiary and affiliate companies, together with their respective officers, directors, owners employees partners and agents harmless from any and all claims, losses, damages, liabilities, lawsuits, fines, penalties, costs and/or expenses including but not limited to reasonable attorney’s fees and court costs, arising out of, resulting from or caused, either directly or indirectly, by: (i) your breach or violation of these General Terms and Conditions; and/or (ii) your use of, participation in, and/or access to the services offered in our website or app.

SagaPoll reserves the right to make changes to these General Terms and Conditions. We commit to publishing the changes via our mobile app, and, as an option, with a notice sent to you.
